No admission test for children till std 8 rules HCIn a landmark order passed by division bench of Bombay High Court, the elite schools are restrained from conducting an admission test for children up to Std. VIII. The judges, Justice Abhay Oka and Justice Revati Mohite Dere ruled that the admissions granted after such tests are illegal and liable to be cancelled. The judges invoked provisions of RTE (Right To Education) which clearly state that while admitting a child to the school, neither any capitation fees be paid nor a child or parents of the child be subjected to any sort of screening procedure.

While rejecting the plea of the school, Jnana Prabodhini Prashala, that the ban of screening only applied to nursery or Std I admissions, the bench observed that, “There is nothing in the rules to indicate that the prohibition of subjecting the students or parents to screening procedure will apply only to the nursery or Std I”.

The court upheld the order of the education officer who had directed the school management to conduct a fresh process; however given that half of the academic year has already passed, the order would take effect only at the end of the second term.

The High Court order is like to have a far-reaching impact on elite schools who follow the practice of subjecting the children and/or the parents to an entrance test.
